Mobile Deposit Terms and Conditions

This Mobile Deposit User Agreement (Agreement) contains the terms and conditions for the use of the FRB Federal Credit Union’s Mobile Deposit Service that the FRB Federal Credit Union (‘FRB Federal Credit Union’, ‘we’ or ‘us’) may provide to an FRB Federal Credit Union member, (‘member’, ‘you’, ‘ ‘your’).  Other agreements you have entered into with the FRB Federal Credit Union, including the FRB Federal Credit Union Membership Account Agreement and Disclosures, and the Terms and Conditions of the MOBILE BANKING Application, as applicable to your FRB Federal Credit Union account(s), are incorporated by reference and made a part of this Agreement.

Service Definitions

"Business Day"- Monday through Friday Eastern Time, excluding Federal Reserve Bank holidays.
"Cut-Off-Time" - the point in the business day before which a check must be deposited.
"Service" refers to the FRB Federal Credit Union's Mobile Deposit.

Use of Service
The Service allows you to make deposits into an eligible FRB Federal Credit Union Share Draft Checking Account from a remote location by photographing the checks with a compatible mobile device, which then delivers the images and associated deposit information to the FRB Federal Credit Union electronically. You may use this Service only for non-business, personal use in accordance with this Agreement. In order to use this Service, you must obtain and maintain, at your expense, compatible hardware and software. We are not responsible for the functionality or maintenance of any third-party hardware or software you may need to use the Service.

Agreement Acceptance
This Agreement applies to members’ primary share draft checking accounts only.  The use of the Service means you agree to all terms and conditions in this Agreement.  This Agreement is subject to change from time to time. The FRB Federal Credit Union reserves the right, in its sole discretion, to change, modify, add or remove portions from this Service without prior notice. Your continued use of this Service will indicate your acceptance of any such changes to this Service. Please read this Agreement carefully and keep a copy for your records.

Eligibility and Qualification Requirements
To qualify for this Service, you must meet be:

  • at least 18 years old; and
  • a Member in Good Standing; and
  • currently enrolled in Mobile Banking

Notwithstanding the above, you may be denied access to this Service for violations of this Agreement or other serious account issues, which are determined at the FRB Federal Credit Union’s sole discretion. These serious account issues include, but are not limited to, potential fraud or security concerns, unknown address, and identity or membership verification.

Eligible Share Accounts

  • Primary Share Draft Checking Account

The FRB Federal Credit Union reserves the right, in its sole discretion, to change, modify, add or remove share accounts eligible for this Service.

Limitations of Service
When using this Service, you may experience technical or other difficulties. We do not assume liability for any technical or other difficulties or any resulting damages that you may incur. We reserve the right to change, suspend or revoke services immediately and at any time without prior notice to you. In the event this Service is not available to you for any reason, you acknowledge that you can deposit your check at a branch office location, through a participating ATM or by mail.

Charges or Fees
The FRB Federal Credit Union does not charge a usage fee for use of this Service. We reserve the right to start charging for this Service at any time.  You acknowledge that wireless providers may assess message and data rates, as well as fees, limitations or restrictions for using this Service. You agree that you are solely responsible for all such fees, limitations, and restrictions, and that we may contact you via your wireless device for any purpose concerning your share accounts at the FRB Federal Credit Union, including but not limited to account servicing and collection purposes.

Returned Checks and Share Drafts
If a check you transmit for deposit is dishonored, rejected or otherwise returned unpaid, you agree that we may charge back the amount of the returned check to the account the check was originally deposited to, and you will be assessed a fee in the amount shown on the FRB Federal Credit Union’s current Schedule of Fees and Charges for a returned check. If there are not sufficient funds in your account to cover the amount of the returned check, the account will be overdrawn and you will be responsible for payment in accordance with the terms and conditions of your account agreement with the FRB Federal Credit Union and the FRB Federal Credit Union Membership Agreement and Disclosures. You agree that the FRB Federal Credit Union may debit any account maintained by you in order to obtain payment of your obligations under this Agreement.

Eligible Items
You agree to deposit only "checks," which are defined as negotiable demand drafts drawn on, or payable through, or at an office of a bank or credit union. When the image of the check transmitted to the FRB Federal Credit Union is converted to an Image Replacement Document for subsequent presentment and collection, it shall thereafter be deemed a “check” within the meaning of Articles 3 and 4 of the Uniform Commercial Code.

Ineligible Items
You agree that you will not use this Service to deposit any ineligible items, including, but not limited to, the following:

  1. Checks payable to any person or entity other than you and/or your joint member;
  2. Post-dated checks (a check or draft with a future date);
  3. Stale-dated checks (a check or draft dated more than 6 months prior to the date of deposit);
  4. Money orders and travelers checks;
  5. Starter or counter checks;
  6. American Express® Gift Cheques;
  7. Savings bonds;
  8. Checks not payable in United States currency;
  9. Checks drawn on financial institutions located outside the United States;
  10. Checks drawn or otherwise issued by you or any other party on any of your own FRB Federal Credit Union share accounts;
  11. Checks containing an obvious alteration to any of the fields on the front of the check or checks which you know or suspect, or should know or suspect, to be fraudulent;
  12. Checks that are incomplete;
  13. Checks previously converted to a substitute check or an Image Replacement Document;
  14. Checks that require authorization (e.g., COMCHEKS, RapidDrafts);
  15. State-issued registered warrants;
  16. Checks from a closed account at another financial institution.
    The FRB Federal Credit Union reserves the right, in its sole discretion, to determine what checks may be considered “Ineligible Items.”

Endorsement Requirements
You agree to endorse all checks with your signature and print "For Mobile Deposit Only, FRB FCU, Account Number, and Member's Signature" on all checks.  Checks also payable to a joint member must be signed by the joint account holder.  Endorsements must be made on the back of the check within 1 1/2 inches of the top edge.  The FRB Federal Credit Union reserves the right to reject all checks that are not endorsed as specified.
Deposit Limits
When using the Service to deposit funds,

  • the number of deposits you can make is limited to 10 deposits per Business Day;
  • the aggregate amount of deposits is not to exceed $10,000 per Business Day.

The Credit Union reserves the right to modify limits on the amounts and/or number of deposits from time to time. You agree to comply with all such limits.

Making the Deposit
The Mobile Deposit program will guide you through the necessary steps to complete the deposit.  You will be asked to provide the dollar amount of the check.  You will be prompted to take a photo of the front and back of the check, making sure the endorsement is complete, and to submit and confirm transmission of the check for processing.  The program may identify some potential processing issues, such as: Image Quality or Missing Endorsement, and prompt you to correct the deficiency.

Image Quality
The image of the check transmitted to us must be clearly legible as determined in the sole discretion of the FRB Federal Credit Union. The image being transmitted must comply with all standards for image quality established by the American National Standards Institute (ANSI), the Board of Governors of the Federal Reserve, or any other clearing house, association or regulatory agency.

Receipt of Checks for Deposit
The cut off time for deposits to be processed on the day of transmission is 3:00 p.m. ET.  After a check has been successfully submitted, the processing of checks takes place in two stages.  To view the status of a deposit go to ‘Check Deposit History’. Checks in process will be shown as ‘Pending’.  The status will change to ‘Accepted’ when the check is ready to be processed for deposit to your Share Draft Account. If the check is declined the status will show ‘Failed’. If a ‘failed’ check can be re-deposited we will notify you by telephone or email. 
We reserve the right, at our discretion, to reject any check or item transmitted through this Service. You will receive an email notification if the deposit is rejected. We are not liable for checks or items we do not receive or for images that are not transmitted completely. 

Funds Availability Policy
Any credit given for checks deposited using this Service is provisional and subject to verification and final approval of the check.
You agree that checks transmitted using Mobile Deposit are not subject to the funds availability requirements of Federal Reserve Board Regulation CC. The FRB Federal Credit Union, at its sole discretion, may place an additional hold on any check for a reasonable period until the settlement of the check is deemed to be complete. We will notify you if we delay your ability to withdraw funds for any reason and we will tell you when funds will be available. Funds will generally be available no later than seven (7) Business Days after the day of deposit. You agree to receive all notifications regarding your use of this Service, including, but not limited to notices required by law or regulation, electronically. With respect to each check you transmit to the FRB Federal Credit Union for deposit, you agree to indemnify and reimburse the FRB Federal Credit Union for and hold the FRB Federal Credit Union harmless from and against any and all losses, costs and expenses.

Method of Presentment
The manner in which checks are cleared, presented for payment and collected shall be in the FRB Federal Credit Union's sole discretion, subject to the FRB Federal Credit Union Membership Account and Disclosures governing your account.

Prohibitions Against Presenting a Check More Than Once
Once you have used the Service to deposit a check, you agree not to present or allow anyone else to present the original check or a substitute check of the check again for deposit through the Service or by any other means.  If you or anyone else presents a check or substitute check for deposit more than once, in violations of this Agreement, you agree to indemnify, and defend and hold the FRB Federal Credit Union harmless from and against all liability and damages that may result from any claims, suits or demands from third parties with respect to such a check or substitute check.  You agree that we may debit from your share account(s) the aggregate amount of any checks that are deposited more than once.

Retention and Disposal of Checks
You agree to retain each check no fewer than 60 Business Days after your funds have been posted to your account. Upon receipt of the funds, you agree to mark the check(s) prominently as "VOID" and to store the checks(s) in a way that prevents re-presenting for payment. You agree to store each retained check in a secured locked container until proper disposal is performed.
You will promptly provide any retained check to the FRB Federal Credit Union, as requested, to aid in the clearing and collection process or to resolve claims by third parties with respect to any check. You will notify us immediately by telephone at (202)452-2800 or (314)444-8904 if you learn of the loss or theft of the original check. This must be followed up by a written confirmation. The check must be destroyed after 60 days by cross-cut shredding or another commercially acceptable means of destruction. After destruction of an original check, the image will be the sole evidence of the original check.

Errors or Discrepancies
Notify the FRB Federal Credit Union at (202)452-2800 or (314)444-8904 as soon as possible regarding any suspected errors in checks deposited through this service. You must notify us no later than sixty days after we sent the FIRST statement on which the problem appeared. If you do not notify us within sixty days from the date your statement was sent, such statement regarding all deposits made through this Service shall be deemed correct, and you will be prohibited from bringing a claim against the FRB Federal Credit Union for such alleged error.

Security Requirements
To prevent unauthorized usage of the Service, you agree to ensure the security of any device you use to access the Service. This includes, but is not limited to, installing operating system patches, antivirus software, firewall and spyware detection as applicable and keeping this security software current, as well as securing the physical device from theft or unauthorized use. Additionally, the FRB Federal Credit Union may also request additional information from you about the security of your devices.

Changes in Terms and Provision of Service
Except as otherwise required by law, the FRB Federal Credit Union reserves the right in its sole discretion to change these terms, and modify or cancel your Mobile Deposit service at any time, without prior notice. The FRB Federal Credit Union may terminate or suspend Mobile Deposit service at any time at our discretion, without notice to you.
Members are responsible for reviewing the terms and conditions related to any such changes, modifications or additions. The use of the Service(s) means you agree to all terms and conditions in this Agreement.  You will want to keep a current copy for your records.
In the event of an inconsistency between prior Terms and Conditions applicable to the FRB Federal Credit Union MOBILE BANKING Application and these Terms and Conditions, these Terms and Conditions shall apply. Undefined terms herein shall have the meaning assigned to them in the Membership Account Agreement and Disclosures Booklet. These Terms and Conditions supplement the Membership Agreements and Disclosures. In the event of an inconsistency between the Membership Booklet and these Terms and Conditions, these Terms and Conditions shall govern. The FRB Federal Credit Union’s privacy policy may be found at

Disclaimer of Warranties
The FRB Federal Credit Union's representations, warranties, obligations, and liabilities, and your rights and remedies, set forth in this Agreement, are exclusive. The software is provided by THE FRB Federal Credit Union and its service providers "as is" and on an "as available" basis. We disclaim all warranties of any kind as to the use of the Service, whether expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. We make no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error free, (iii) the results that may be obtained from the Service will be accurate or reliable, and (iv)any errors in the Service or technology will be corrected.

The FRB Federal Credit Union's liability for errors or omissions with respect to the data transmitted or printed by THE FRB Federal Credit union will be limited to correcting the errors or omissions. Delivery and receipt of information, including but not limited to, instructions you give us, may be delayed or otherwise impacted by factor(s) affecting your phone carriers, other parties, or because of other reasons that we cannot control. You accept the risk that a Deposit may be intercepted or misdirected during transmission. THE FRB Federal Credit Union will not be liable for losses or damages arising from: any disclosure of account information to third parties; failed, delayed, or misdirected delivery; mishandling; or inaccurate content in information and instructions transmitted using the Service.


User Warranties and Indemnification
By using this Service, you warrant to the FRB Federal Credit Union that:

  1. You will only transmit eligible checks that are properly endorsed;
  2. You will only transmit images that meet the image quality standards;
  3. You will not transmit duplicate checks;
  4. You will not re-deposit or re-present the original check once it has been scanned and sent through this Service, unless specifically requested to do so by the FRB Federal Credit Union.
  5. All information you provide to the FRB Federal Credit Union is accurate and true;
  6. The FRB Federal Credit Union will not sustain a loss because you have deposited a check;
  7. You will comply with this Agreement and all applicable rules, laws and regulations;
  8. Checks you transmit do not contain viruses;
  9. Only authorized persons shall have access to the original deposit check;
  10. The information contained on the check shall not be disclosed to unauthorized persons; and,
  11. The original check will not be duplicated, scanned or photographed for deposit, and will not be presented, negotiated or deposited in any way.

You agree to indemnify and hold harmless the FRB Federal Credit Union from any loss for breach of this warranty provision. Any breach of the above warranties may result in cancellation of this Service for your specific profile in the FRB Federal Credit Union Mobile application or closure of your share accounts.

Governing Law
This Agreement supplements the terms of your Membership Agreement and related account Disclosures. Together, they constitute the entire agreement between you and the FRB Federal Credit Union with respect to the Service. You may not assign this Agreement. This Agreement is governed by federal law and the laws of District of Columbia. A determination that any provision of this Agreement is unenforceable or invalid shall not render any other provision of this Agreement unenforceable or invalid. Unauthorized use of this Service is strictly prohibited.
